Terms of Service

These Terms of Service (“Terms”) govern your use of BabyNote (the “Service”) and your rights, obligations, and responsibilities as a user (“Member”). By creating an account, you agree to be bound by these Terms.

1. Purpose

These Terms define the conditions of use and operational matters of the BabyNote mobile application service provided to parents and guardians for recording childcare information.

2. Definitions

1. “Service” — The BabyNote mobile application and all related features.
2. “Member” — A user who has agreed to these Terms and completed registration.
3. “Child Profile” — Information about a child (name, date of birth, sex) that a Member enters directly.
4. “Activity Records” — Logs of feedings, sleeps, diapers, growth, inventory, routines (walks, baths, supplements, snacks), health (symptoms such as cough, vomiting, rash, injury), pediatricians, and vaccinations.
5. “Family Plan” — A paid subscription that includes premium features such as unlimited child profiles.

3. Account Registration

1. Only parents or guardians aged 14 or older may register an account.
2. Members are responsible for safeguarding their account credentials.
3. Accounts created through deception or impersonation may be cancelled without notice.

4. Service Features

The Service provides:

• Per-child childcare records (feeding / sleep / diaper / growth)
• Routines (walks, baths, supplements, snacks) and health logs (symptoms such as cough, vomiting, rash, injury)
• Formula and diaper inventory tracking with depletion alerts
• Pediatrician registry and vaccination schedule
• Family sharing (caregiver invites, real-time sync)
• WHO percentile visualization for growth
• Statistics and charts
• Android home screen widget (iOS support coming)

5. Paid Services / Payment

1. The first child has unlimited access to all core features for free.
2. Adding additional children requires a Family Plan subscription.
3. Payments are processed through Google Play or the Apple App Store. Payment information is governed by each store’s policies.
4. Subscriptions auto-renew. You may cancel up to 24 hours before the renewal date through your store account.
5. Refunds follow each store’s refund policy (Google Play Refund Policy, Apple App Store Refund Policy).

6. Member Obligations

Members shall not:

1. Misappropriate or falsify personal information.
2. Use information obtained through the Service for commercial purposes.
3. Interfere with normal operation of the Service (automated tools, scraping, etc.).
4. Post or share obscene, violent, discriminatory, or otherwise socially inappropriate content.
5. Collect or distribute other Members’ child information without consent.

Violations may result in account suspension or data deletion without notice.

7. Service Changes and Suspension

1. The Service operator may modify or suspend all or part of the Service for business or technical reasons.
2. Changes will be communicated via in-app notice or email in advance.
3. The operator is not liable for temporary outages due to force majeure (natural disasters, system failures, etc.).

8. Intellectual Property

1. All copyrights and intellectual property rights in the Service belong to BabyNote.
2. The Member retains copyright in their Activity Records, and the Service uses them only for the purpose of providing the Service.

9. Limitation of Liability

1. Growth curves, percentiles, and similar features provided by the Service are reference information based on WHO standards and do not replace medical diagnosis. Always consult a qualified healthcare professional for medical decisions.
2. Smart notifications (low formula, vaccine schedules, etc.) are estimates based on user input and are not guaranteed to be 100% accurate.
3. The Service is not liable for losses caused by incorrect input or misuse by the Member.

10. Account Termination / Data Deletion

1. A Member may terminate their account at any time via Settings → Account → Delete account within the app.
2. Upon termination, all Member, Child, and Activity data is deleted immediately, except for data legally required to be retained.
3. If a Member has children linked via Family Sharing and is the last guardian, the Member must invite another family member before they can terminate.

11. Dispute Resolution

1. These Terms are governed by the laws of the Republic of Korea.
2. Any disputes arising from use of the Service will first be addressed through good-faith negotiation between the parties.
3. If negotiation fails, disputes will be resolved in the courts having jurisdiction under the Civil Procedure Act of Korea.

For users in the EU/UK and the US, mandatory consumer protection laws of your country of residence apply in addition to these Terms.

12. Miscellaneous

Matters not addressed in these Terms shall be governed by applicable laws and generally accepted commercial practice.
